Liability of the employee for damage Abstract The content of this thesis is the issue of employee's liability for damage caused to employer. The topic of the thesis is constantly relevant, as it concerns a large number of people, because in the first quarter of 2020 more than four million employees were registered in the Czech Republic. The issue of employee's liability for damage, respectively its compensation is a very sensitive topic for employees, as compensation for damage, for example in the amount of several monthly incomes, is a significant intervention in the economic situation of almost every employee. In addition, the regulation of employee liability for damage, given its long- term strong protection of employees, can have an impact on the labor market, as employers are often exposed to the significant risk of damages they may demand from employees. As a result, employers may prefer other forms of cooperation than on the basis of an employment contract. Název diplomové práce v anglickém jazyce Employee's liability for damage with respect to the case law Summary The purpose of my diploma thesis is to analyse the main aspects of employee's liability for damage in labour law with respect to the current legislation and current case law. By using the analytic and descriptive methods the valid legal provisions are described and evaluated. The thesis is composed of eight chapters, each of them dealing with different aspects of liability of an employee. Chapter One is introductory and describes employee's liability in labour law in general. Following chapters examine relevant Czech legislation and related case law. Chapter Two presents the importance of damage prevention. The chapter consists of three subchapters. Subchapter One focuses on damage prevention and general obligations of an employee. Subchapter Two describes employee's special obligation to notify his supervisor in case of imminent damage. Subchapter Three investigates special obligation of an employee to take an action against imminent damage. Chapter Three relates to Chapter Two. The thesis is devoted to employee s liability for damages. The first chapter describes a system of labour law and its main sources. The successive chapter discusses the employment, defines its subject, object and content, and briefly defines the basic types of employment. Another chapter is devoted to responsibility as such, followed by a chapter focusing on responsibility in labour relations. An important part of this thesis is the types of labour employee s liability for damages and compensation. The work also briefly discusses the possibility of liability s insurance and moderation. The last chapter deals with specific fields examples, which is the basis for evaluation of legislation and recommendations for employees and employers.

The subject of this rigorous thesis is the institution of the labour liability of the employee for damage caused to the employer. The reason that led me to choosing this topic was initially my own experience which I had gained quite early on after being employed as an articled clerk. The core of this experience was a mistake in calculating the amount of our client's receivable. Due to this error of mine our client lost the chance to acquire the entire amount of the receivable for a certain period of time. It was in this moment that I have realized that every employee can quite easily and without intention case damage to his/her employer. I became interested in this field including the possibility for a commercial insurance for this instance. With regard to the above I am of the opinion that the institution of labour liability of the employee for a damage caused to the employer should interest every employee and every employer even before any such damage arises. The goal of this rigorous thesis is to analyse its topic, the labour liability, in detail including how it fits into a broader topic of legal liability as such and in general into legal labour relations. This bachelor thesis adresses the liability of an employee for damage and is primarily focused on liability for the deficit on fiduciary values that the employee is obliged to bill. The thesis comprises of 5 chapters. The first chapter introduces the general term of responsibility and legal liability. Second chapter focuses on liability in labor law and third chapter is already adressing liability for damage. Liability of the employee will be discussed in fourth chapter with a focus on the deficit on fiduciary values that the employee is required to bill. Based on the jurisprudence and professional articles, I will will study to which extent is right to require a liability after an employee and how and under which circumstances can be an employee released from it. In order to fulfill my aims I also analysed the chosen court judgment of the High Court of the Czech republic.

This work deals with the theoretical definition of the basic concepts of employment law. It defines main participants of employment relations, outlines liability relations and explains function of the liability institute. Work is deeper devoted to general and specific labor responsibility and the practical part analyzes both historical and contemporary court decisions of the Czech and Slovak Republic in the matter. It evaluates development of legislation after separation of republics in 1993 and then compares differences on specific cases.
